Article 1 – Agreements

  1. An agreement is concluded after Smartlures BV accepts the order and when written confirmation (by email) has been sent to the consumer. Smartlures BV  reserves the right to refuse orders or impose conditions on the order.
  2. Agreements between Smartlures BV and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law.
  3. The invoice for your order can be found in your personal account at https://smartlures.nl . The invoice will be visible as soon as we have processed your order.

Article 3 – Prices

  1. All prices in the webshop include VAT and exclude shipping costs.
  2. If payment for your order is not received within 14 days, the order will be cancelled and the goods will no longer be delivered to the consumer. A new order will then need to be placed.
  3. Smartlures BV reserves the right to permanently change prices in response to fluctuations in the financial market and rising supplier prices.

Article 4 – Offers and promotions

  1. All promotions by Smartlures BV are without obligation and Smartlures BV reserves the right to change prices at any time.
  2. The promotions listed on the site are only valid for orders placed within the promotion period, while stocks last.
  3. In-store promotions may differ from promotions on www.smartlures.nl

Article 5 – Payment options

  1. You can choose from the following options when making your payment:
    • iDeal
    • Bank transfer
    • Credit card
    • PayPal
    • Pay in the store in Lelystad

Article 6 – Delivery

  1. At Smartlures BV, we guarantee fast delivery. We do our utmost to deliver your order as quickly as possible. Orders placed and paid for on weekdays before 4:00 PM are shipped the same day.
  2. Smartlures BV  We will take the utmost care when receiving and fulfilling product orders. However, due to circumstances, we may not be able to deliver your order in full. We reserve the right to deliver your order in parts or in part, for example, if a product is out of stock.
  3. You will generally receive your order within a few business days. Delivery is handled by PostNL mail carriers or parcel delivery personnel. However, delays may occur at PostNL (the shipping company). We are not responsible for these delays. If your order is delayed by at least 5 business days, please contact us.
  4. Smartlures BV will fulfill accepted orders within 30 days, unless a different delivery period has been agreed upon with the consumer. Smartlures BV must always communicate this to the consumer. Any product with a longer delivery period must be notified no later than 30 days after placing the order.
  5. If Smartlures BV has not notified the consumer within 30 days of placing the order that a product has a longer delivery time, the consumer has the right to cancel the agreement without costs.
  6. After termination in accordance with the previous paragraph, Smartlures BV will refund the amount paid by the consumer.
  7. Orders can also be picked up. You can schedule an appointment by contacting us.
  8. The place of delivery is the address that the consumer provided to Smartlures BV at the time of entering into the agreement.
  9. Did you provide the wrong delivery address? Please contact us as soon as possible. We'll then try to change the order for you if possible.

Article 7 – Obligation of the consumer during the cooling-off period

  1. If you return the product, please handle it with care in the meantime. The product will only be unpacked to the extent necessary to assess whether it meets your expectations. The consumer should treat the product as they would inspect it in a store, without actually using it.
  2. The consumer is liable for any diminished value of the product resulting from the handling of the product in a way that goes beyond what is permitted in the above paragraph.

Article 8 – Returns

  1. You might sometimes want to return (part of) your order. Perhaps because you're not satisfied with the product, or perhaps there's another reason why you don't want (part of) the order. Whatever the reason, you have the right to return (part of) your order up to 14 days after receipt (your right of withdrawal). The 14-day cooling-off period begins the day after you receive the product.
  2. Always include the return form with your return. This can be found at https://smartlures.nl . Returns without a return form will have a longer processing time.
  3. If the returned product is damaged, or the packaging is damaged beyond what's necessary to try it out, we may charge you for a reduction in value. Therefore, please handle the product with care and ensure it is properly packaged when returning it. Returned items must be unused, clean, and in good condition for sale.
  4. Gift cards cannot be returned.
  5. The shipping costs for returning the items are the responsibility of the consumer. In some cases, an exception applies; one of our specialists will inform you of this.
  6. You can also return or exchange a product in the store during store opening hours.
  7. As a consumer, you bear the risk of damage or loss during transport. Therefore, please package the product securely and retain the shipping receipt until you receive notification from us. You can choose to receive a credit for the returned products or use a voucher for the value of the returned products, taking into account any depreciation.
  8. If you're returning an order that included free items, for example, from a special promotion, these must also be returned. If the free items are not included in the return shipment, we will not process your return.

Article 9 – Repairs

  1. When reporting a repair, you must always include a fully completed repair form.
  2. Proof of purchase must be present for repairs. Repairs are not possible without a receipt/proof of purchase.
  3. The processing of a repair takes at least 4 weeks.
  4. Waders and boots must be presented for repair dry and clean before we send them to the repairer.

Article 10 – Gift vouchers

  1. The gift card amount must be spent all at once. It is not possible to have any remaining balance.
  2. Gift cards cannot be returned.
  3. Gift cards cannot be exchanged for cash.
  4. Redeemable in the Smartlures BV webshop as well as in the store.
  5. Smartlures BV gift cards are valid for two years. After this period, the gift card is no longer valid.
  6. The validity period starts on the day of purchase.
  7. Gift cards cannot be used for outstanding orders.
  8. If you lose your gift voucher, we cannot issue a new one.
  9. If the total amount of the order is higher than the value of the gift card(s) used, the difference must be paid using one of the other payment methods.

Article 11 – Warranty

  1. Smartlures BV supplies only high-quality products. If the customer is not satisfied, the products can be returned, and the matter will be processed.
  2. The warranty period varies by brand. We recommend contacting our specialists for information about the warranty period for each brand.

Article 12 – Complaints procedure

  1. Complaints about the performance of the agreement or delivered products must be submitted to Smartlures BV fully and clearly described within a reasonable period after the consumer has discovered the defects.
  2. Complaints submitted to Smartlures BV will be answered within 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, we will respond within 14 days with a confirmation of receipt and an indication of when the consumer can expect a more detailed response.

Article 13 – Privacy Statement

  1. Protection of your data
    Smartlures BV considers the protection of its customers' data to be of paramount importance. We therefore ensure that the personal information you provide is always treated confidentially, thus safeguarding your privacy. Below, we provide more information about our privacy policy.
  2. The use of your data
    When you order through the Smartlures BV website, we require certain information from you. This information allows us to process your order and keep you informed of its status. The personal information you provide will be used solely for processing your orders. Smartlures BV never shares customer information, sells it, or rents it to third parties. Further use, such as for newsletters, is also prohibited without your express consent.
